SECTION 6 — PRODUCT SAFETY, INSTALLATION, AND ASSUMPTION OF RISK Vacuum tubes, amplifiers, and amplifier components operate at high voltages that can cause serious injury or death, even when an amplifier is unplugged, because capacitors can store a lethal charge. Our products are sold for installation and service by a qualified amplifier technician. You are responsible for correct installation, biasing, and use of any product, including following your amplifier manufacturer's specifications. To the fullest extent permitted by law, you assume all risk associated with the installation, servicing, and use of our products, and Magic Parts LLC is not liable for any injury, property damage, or equipment damage arising from improper installation, biasing, handling, or use.

SECTION 7 — OPTIONAL TOOLS We may provide access to third-party tools "as is" and "as available" without warranties. We have no liability arising from your use of optional third-party tools.

Any dispute or claim arising out of or relating to these Terms or your purchase or use of our products shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring a qualifying claim in small-claims court. You and we each waive any right to a jury trial and any right to participate in a class, collective, or representative action. You may opt out of this arbitration agreement by emailing orders@magicparts.com within 30 days of your first purchase, stating your name and that you opt out of arbitration. If any part of this section is found unenforceable, the remainder shall still apply, except that the class-action waiver is non-severable from the arbitration agreement.

SECTION 19 — ENTIRE AGREEMENT These Terms and any policies posted by us constitute the entire agreement between you and us and govern your use of the Service, superseding any prior agreements. Our failure to enforce any right or provision is not a waiver of that right or provision.
